Amazon Associates USA – Amendment to the Agreement (August 28, 2013)

Amazon has announced changes that can be read here:

My summary of the changes:

  • Changes related to the care of children under 13 (the Children's Online Privacy Act)
  • Addition of Missouri to excluded states
  • Added $ 200 maximum commission for "Fine Art" products

Update of the Partners' Operating Agreement effective August 28, 2013

Associate Program Operating Agreement – Section 2 (Registration), first paragraph

Version of August 28, 2013
"To begin the registration process, you must submit a complete and accurate program application. You must identify your site in your application. We will evaluate your application and inform you of its acceptance or rejection. We may reject your application if we determine that your site does not suit you. Inappropriate sites include those that:
(a) promote or contain sexually explicit material;
(b) promote violence or contain violent materials;
(c) promote or contain defamatory or defamatory material;
(d) promote discrimination or discriminate on the grounds of race, sex, religion, nationality, disability, sexual orientation or age;
e) promote or engage in illegal activities;
(f) are directed to children under the age of 13 as defined by the Children's Online Privacy Protection Act (15 United States of America, ยงยง 6501-6506) and any regulation made under that Act;
(g) include a trademark of Amazon or its affiliates, or a variation or spelling of a trademark of Amazon or its affiliates under a domain name, a subscript name domain or any username, group name, or other identifier on any social networking site (see trademark guidelines for examples); or
(h) violate intellectual property rights. "

"In addition, if, at any time after you enroll in the program, you become resident of Arkansas, Colorado, Illinois, Minnesota, Missouri, North Carolina or Rhode Island, You will no longer be able to participate in the Program and this Operating Agreement, will automatically terminate on the date you establish your residence in that State, and you must promptly notify us in writing of your residence in the State. Arkansas, Colorado, Illinois, Minnesota, Missouri, North Carolina or Rhode Island, via the Contact Associates Customer Service Form available here. "

"In addition, if at any time after you enroll in the program, you become resident of Arkansas, Colorado, Illinois, Minnesota, North Carolina or Rhode Island, you will no longer be able to participate in the program, and this operating agreement terminate, on the date you establish the residence in that state.In addition, you must inform us promptly in writing of your residence in Arkansas, Colorado, Illinois, Minnesota, North Carolina or Rhode Island, via the Contact Associates Customer Service Form available here. "

Associate Program Advertising Fee Schedule – Advertising Fee Limits for Certain Products, First Paragraph

"Notwithstanding the advertising rates described on this page, the following limitations apply: (a) advertising costs for all eligible purchases of products that are personal computers (including, without limitation, desktop computers laptops, laptops, tablets and netbooks) are limited to a maximum of $ 25 per computer, regardless of the eligible revenues from the sale of this product; and (b) advertising costs for all eligible purchases of Fine Art products are limited to $ 200 per product, regardless of the eligible revenue from the sale of that product. "

Conditions of participation in the program of associates

A new paragraph 31 is inserted at the end of the conditions of participation in the associate program:
"31. You will not collect, use or knowingly disclose personal information to children under 13 years of age. "
