Can a dedicated server provider assign a bad reputation IP address to the client?

I ordered a new dedicated server from a reputable company and received the server details.

After configuring the DNS / Name servers, the first email sent to Gmail is passed to SPAM. (not just test, email with valid content). When I checked the reputation of the e-mail address of the IP address, I found that the IP address used to send a large number of e-mail -mails was identical to that of per just 10 days ago.

It looks like they assigned me the IP to another client to send a lot of emails.

But when I explain that and I ask to replace intellectual property, they simply refuse to say that it goes against their policy.

So, is it fair for them to do that?

With this situation, the server is no longer used for me and it is a waste of money.
